Terms and Conditions

These Terms and Conditions (“Terms”) govern all sales, services, and agreements made by Millheim Honey Company (“Seller”) with customers, clients, or purchasers (“Buyer”). By placing an order, making a deposit, purchasing products, or contracting services from Seller, Buyer agrees to be bound by these Terms.

1. DEFINITIONS

Buyer: Any individual, company, or organization purchasing goods or services from Seller.
Seller: Millheim Honey Company, including its employees, agents, and authorized representatives.
Goods: All honey, honey infusions, bees, bee colonies, bee removal services, wax products, spice blends, merchandise, and any products offered by Seller.
Services: Any bee-related services such as removals, pollination, educational presentations, delivery, and consultations.
Contract: The legally binding agreement formed between Seller and Buyer upon order confirmation or deposit receipt.
Deposit: An upfront payment made to secure goods or services prior to full delivery or performance.

2. ACCEPTANCE OF TERMS

By ordering products, submitting a deposit, or using Seller’s services, Buyer acknowledges full understanding and acceptance of these Terms. Any terms provided by Buyer that differ from these Terms are rejected unless explicitly accepted in writing by Seller. Orders placed through Seller’s website or other sales channels constitute acceptance of these Terms.

3. PAYMENT TERMS

Full Payment: Payment in full is required upon delivery or prior to service completion, except where a deposit arrangement has been made.
Deposits: Deposits are collected to secure custom orders, bee colonies, removals, and special services. Deposits do not constitute full payment. Remaining balance is due before or upon delivery or service completion.
Refundable Deposits: Deposits are refundable less a 10% administrative and processing fee if Buyer cancels. Refund requests must be submitted in writing within 7 days of cancellation. After this period, deposits may be forfeited at Seller’s discretion.
Payment Methods: Accepted forms include:

Cash
Check (payable to Millheim Honey Company)
Credit or debit card (via website or in-person where available)
Venmo or other electronic payment methods as offered by Seller

Returned Checks: Any check returned for insufficient funds or other reasons will incur a $35 returned check fee. Buyer must replace payment immediately via cash, money order, or electronic payment. Failure to do so may result in service suspension or cancellation.
Late Payments: Failure to pay remaining balances on time may result in delayed delivery, additional fees, or cancellation of the order.

4. DEPOSITS & PREORDERS

Purpose: Deposits secure production or reservation of goods or services not available immediately, including bee nucs, specialty honey blends, or scheduled removals.
Deposit Amount: Typically 25-50% of total order price, as specified in the sales quote or invoice.
Refund Policy: Deposits are refundable minus a 10% fee that covers Seller’s administrative and processing costs. This fee applies regardless of cancellation timing.
Cancellation by Buyer: Must be made in writing via email or certified mail. Refunds will be processed within 14 business days of cancellation confirmation, minus the 10% fee.
Cancellation by Seller: In the unlikely event Seller must cancel, Buyer will be refunded full deposits promptly.

5. PRODUCT AVAILABILITY & QUALITY

Products are offered while supplies last.
Seller reserves the right to substitute products of equal or greater value in cases of stock shortages or unforeseen circumstances.
All products are prepared and stored under sanitary conditions according to state and local regulations.
Honey and other natural products may crystallize or vary in color and flavor; these variations do not constitute defects.
Seller does not guarantee uniformity in wildflower honey or other naturally sourced goods.

6. DELIVERY & PICKUP

Pickup: Available during posted business hours or by prior appointment. Buyer is responsible for timely pickup. Seller may leave items in designated secure areas when Buyer is unable to pick up in person, but Seller is not liable for loss or damage thereafter.
Local Delivery: Available on a case-by-case basis, usually for larger orders or special circumstances. Delivery fees may apply and must be paid upfront or included in final invoice.
Access for Bee Removals: Buyer must provide safe and reasonable access to the site at scheduled time. Failure to provide access may result in rescheduling fees or cancellation.
Risk Transfer: Risk of loss or damage passes to Buyer upon delivery or pickup confirmation.

7. RETURNS & EXCHANGES

Due to the perishable and natural nature of products, all sales are final unless product is defective or damaged on arrival.
Buyer must inspect products upon receipt and notify Seller within 3 business days of any issues with photographic evidence.
Seller may offer replacement, exchange, or refund at Seller’s sole discretion.
No returns are accepted on honey after opening.

8. WARRANTIES & LIABILITY

Seller warrants that products meet quality standards at time of sale.
Seller disclaims all other warranties, expressed or implied, including fitness for a particular purpose or merchantability.
Buyer assumes responsibility for proper use, storage, and handling of products.
Seller is not liable for allergic reactions or health issues arising from use or consumption of bee products.
Under no circumstances will Seller be liable for indirect, incidental, consequential, or punitive damages.

9. BEE REMOVAL & SERVICE RISKS

Bee removal and related services involve risks including stings, damage to property, or unforeseen complications.
Buyer certifies they have disclosed all known safety hazards and property conditions that could affect service.
Buyer accepts full responsibility for risks inherent in bee removal activities.
Seller’s liability for property damage or personal injury is limited to direct damages caused by Seller’s negligence, excluding any indirect or consequential damages.

10. INTELLECTUAL PROPERTY

All logos, trademarks, trade names, product designs, and content created or used by Seller remain the sole property of Millheim Honey Company.
Buyer may not reproduce, copy, or distribute Seller’s intellectual property without written permission.

11. CANCELLATION POLICY

Buyer may cancel orders within 24 hours of order placement with full refund of deposits.
Cancellations made after 24 hours but prior to production or delivery may be subject to forfeiture of deposits less the 10% fee.
For bee services, cancellations made with less than 48 hours’ notice will forfeit deposits except under exceptional circumstances approved by Seller.
Seller reserves the right to cancel orders due to unforeseen circumstances and will refund deposits promptly.

12. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the State of Texas.
Any disputes arising hereunder shall be resolved exclusively in the courts of Austin County, Texas, or the county where Seller resides at the time of dispute.

13. FORCE MAJEURE

Seller is not liable for delays or failure to perform due to events beyond reasonable control, including but not limited to natural disasters, severe weather, pandemics, supply chain disruptions, acts of government, or equipment failure.

14. MODIFICATIONS TO TERMS

Seller reserves the right to modify these Terms at any time. The most current version will be posted on the official website and will apply to all orders placed thereafter.
